These Terms & Conditions (“Terms”) govern your access to and use of the ApolloSRM marketing site and platform provided by Apollo SRM, Inc. (“ApolloSRM,” “we,” “us”). Institutional customers’ use of the platform is also governed by the written master subscription or services agreement between ApolloSRM and the institution; if that agreement conflicts with these Terms, that agreement controls for the institution and its users.
Acceptance
By accessing or using the site or the platform, you agree to these Terms. If you are using ApolloSRM on behalf of an institution, you represent that you are authorized to do so.
The service
ApolloSRM provides a hosted platform spanning student information, learning management, admissions, compliance, and reporting for career and vocational institutions. We may update, improve, or modify features over time. We aim for high availability but do not guarantee the service will be uninterrupted or error-free.
Accounts and eligibility
You are responsible for the accuracy of your account information, for maintaining the confidentiality of your credentials, and for activity under your account. Notify us promptly of any unauthorized use. Accounts are provisioned and governed by the institution that licenses the platform.
Acceptable use
You agree not to:
- use the service unlawfully or to violate the privacy or rights of others;
- attempt to access data, accounts, or systems you are not authorized to access;
- probe, scan, or test the vulnerability of the service except under an authorized engagement;
- interfere with or disrupt the integrity or performance of the service; or
- reverse engineer or resell the service except as permitted by law or your agreement.
Customer data and FERPA
As between ApolloSRM and the institution, the institution owns its data, including student education records. ApolloSRM processes that data solely to provide the service, consistent with FERPA and the institution’s instructions, and as described in our Privacy Statement. The institution is responsible for obtaining any consents required for its use of the platform.
Third-party integrations
The platform offers optional integrations with third-party services (for example, Google Workspace / Gmail, Microsoft 365, payment and communication providers). Your use of a connected service is subject to that provider’s terms. ApolloSRM’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. You may disconnect an integration at any time.
Intellectual property
ApolloSRM and its licensors retain all rights in the platform, software, and marketing materials. These Terms do not grant you any right to our trademarks or branding except as needed to use the service as intended.
Fees
Fees, if any, are set out in the applicable order or agreement between ApolloSRM and the institution. Free-tier or trial access may be offered and may be modified or discontinued.
Disclaimers and limitation of liability
The service is provided “as is” and “as available,” without warranties of any kind except as expressly stated in a written agreement. To the maximum extent permitted by law, ApolloSRM is not liable for indirect, incidental, special, consequential, or punitive damages, and our aggregate liability is limited as set out in the applicable agreement.
Termination
We may suspend or terminate access for violation of these Terms or as permitted by the applicable agreement. Upon termination, the institution may export its data as provided in that agreement, and we will handle remaining data consistent with our retention and deletion practices.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, communicated to institutional customers.
Governing law
These Terms are governed by the laws of the jurisdiction stated in the applicable institutional agreement, or, absent such agreement, by the laws of the United States and the state in which Apollo SRM, Inc. is organized, without regard to conflict-of-laws rules.
